萨驰智能装备股份有限公司（以下称“萨驰公司”）获知VMI荷兰公司（下称“VMI公司”）在其官方网站刊登了题为“VMI wins ‘significant lawsuit’ against Safe-Run”的文章，针对该文章，萨驰公司答复如下：

Safe-Run Intelligent Equipment Co., Ltd. (“Safe-Run) has recently learnt that VMI Holland B. V. (“VMI”) published an article titled with “VMI wins ‘significant lawsuit’ against Safe-Run” on VMI’s official website. Safe-Run makes the following reply to this article:

自2016年起，因双方之间的知识产权纠纷，萨驰公司与VMI公司在中国陆续发生了数起知识产权侵权诉讼，双方的知识产权诉讼案件目前大多在二审程序中，而其中大多数诉讼中，萨驰公司均获得了一审胜诉判决或裁定。

Due to the IP disputes between Safe-Run and VMI, there have been multiple IP infringement lawsuits happened between the parties in China ever since 2016. Most of the lawsuits are currently undergoing 2nd instance proceedings. Safe-Run has obtained favorable 1st instance judgments or rulings in most of the lawsuits.

VMI公司在文章中所谓的“significant lawsuit”是指双方之间知识产权诉讼的一审判决（（2019）苏05知初251号），萨驰公司已经在合理期限内针对该一审判决提起了上诉并缴纳了上诉费用，该判决并未生效，并不具有法律效力。VMI公司在文章中片面地引用该未生效判决中对其有利的认定，该等认定并非中国法院对双方之间诉讼的最终认定结果，不能据此认为萨驰公司具有侵权恶意。

The alleged “significant lawsuit” in VMI’s article refers to the 1st instance judgment of a malicious IP lawsuit dispute between the parties (case reference number: (2019) S05ZC No. 251). Safe-Run has appealed against this 1st instance judgment within the time limit and paid the appeal fees, and such judgment has not become effective and has no legal force. VMI one-sidedly cited the findings favorable to it in this non-effective judgment, which is not the final and binding judgment made by the Chinese court regarding the malicious lawsuit dispute between the parties. Such finding shall not be used to determine that Safe-Run has malicious intent.

VMI公司在双方众多未决诉讼中有选择地引用了一件对其有利的未生效判决，进行大肆宣传，严重损害了萨驰公司的商誉，针对该等涉嫌构成商业诋毁的行为，萨驰公司将保留采取法律行动的权利。

VMI intentionally choose one favorable non-effective judgment among a number of pending lawsuits between the parties to conduct propaganda, which has seriously damaged Safe-Run’s commercial reputation. Safe-Run reserves its right to initiate future legal actions against such suspected commercial defamation.
